Having built my career at two of Europe's leading patent firms, I returned from the UK to Poland to establish MD IP, a specialist EPO-focused practice serving the chemical and pharmaceutical sectors.

Why? To build an EPO practice that is grounded in the standards, expertise and client service culture that shaped my career in the UK, and that clients and foreign associates can confidently entrust with strategically important European patent matters. That approach has already attracted a growing base of domestic and international clients.

In addition to securing patent protection before the EPO, UK IPO and patent offices worldwide, I have represented clients in contentious proceedings before the European Patent Office, including oral proceedings before both Opposition Divisions and the Boards of Appeal.

Narrowing a chemical class of compounds to a sub-class or to a specific compound can be a legitimate strategy for defending a patent before the European Patent Office. However, where the claim in question also defines the class in quantitative terms, such amendments may give rise to objections under Article 123(3) EPC. This article analyses situations in which such amendments may nevertheless result in an extension of the scope of protection, with reference to the relevant EPO case law.
